Court Decision a Victory for Wildlife
In an important win for conservation, the public’s ownership of wildlife was affirmed by a recent decision from the Texas Court of Appeals, Third District in the Bailey, Peterson v. Texas Parks and Wildlife Department, et al case. The decision can be read here.
Texas Wildlife Association was joined by the following organizations in an amicus brief in support of TPWD: Boone and Crockett Club, Texas and Southwestern Cattle Raisers Association, Texas Chapter of The Wildlife Society, Association of Fish and Wildlife Agencies, National Wildlife Federation, National Wild Turkey Federation, Texas Chapter of the Coastal Conservation Association, and Backcountry Hunters & Anglers. We are thankful for the support of our partners and the wisdom of the Third District Justices. Public ownership of wildlife is the cornerstone of the North American Model of Wildlife Conservation and we very pleased by the court’s affirmation. Wildlife and fisheries face attempts at privatization for commercial interest across our state and nation. This is one more legal precedent to bolster the case of the public trust doctrine.
